Terms of Service

1. Acceptance

By accessing or using HAVN Realty ("HAVN," the "Service") at havn-realty.com, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

HAVN provides AI-powered real estate market intelligence for the Canadian market, including property valuations, market forecasts, portfolio tracking, and deal scanning. The Service is designed for informational purposes to assist real estate investors and professionals.

3. Not Financial or Appraisal Advice

HAVN valuations are not appraisals, and HAVN is not a licensed appraiser or financial advisor. All valuations, predictions, and market analyses generated by our APEX engine are algorithmic estimates based on MLS® listing data and machine-learning models. They are provided "as is" and should not be relied upon as the sole basis for purchasing, selling, or financing real property. Always consult qualified professionals before making financial decisions.

4. Accounts

• You must provide a valid email address to register.
• You are responsible for maintaining the confidentiality of your password.
• One account per person. Automated account creation is prohibited.
• We may suspend or terminate accounts that violate these Terms.

Virtual Office Website (VOW) Terms of Use

HAVN is a Virtual Office Website operated by Intraland Realty Ltd., Brokerage, 28 Grace St., Toronto, ON M6J 2S2, 416-458-3411. Broker of Record: Steve Meze.

The information provided herein must only be used by consumers that have a bona fide interest in the purchase, sale, or lease of real estate and may not be used for any commercial purpose or any other purpose.

Sold prices, comparable sales and other listing data on HAVN are shown only to registered users who are logged in and have accepted these terms. By accepting them you agree that:

1. Your relationship with the brokerage. You acknowledge that you have received the RECO Information Guide. Unless you sign a written representation agreement with Intraland Realty Ltd., Brokerage, you are a self-represented party under the Trust in Real Estate Services Act, 2002 (TRESA), and the brokerage does not represent you.
2. Personal, non-commercial use. You will use the data only for your own personal, non-commercial purposes, to evaluate properties you have a bona fide interest in buying, selling or leasing.
3. No redistribution. You will not copy, redistribute, republish, sell, scrape or otherwise share any of the data, in whole or in part, with anyone else or through any other website, app or service.
4. Registered users only. Sold and comparable-sale data are available only while you are logged in to your own account. You will not share your login or let anyone else use your account.
5. Access is logged and auditable. Your searches, valuations and other use of the data are logged against your account. The brokerage may provide these usage records to the Toronto Regional Real Estate Board (TRREB) for compliance purposes, and TRREB may access this website to verify compliance.
6. Termination. Your access may be suspended or terminated at any time.
7. Accuracy. Information deemed reliable but is not guaranteed accurate by the Toronto Regional Real Estate Board (TRREB). Valuations are algorithmic estimates, not appraisals.
8. Changes. These terms may change. You will be asked to accept any new version before you can view valuations or sold data again.

Listing data provided under licence from TRREB. The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA.

5. Beta Program

HAVN is currently in beta. Features may change, break, or be removed without notice. Data accuracy may vary. We appreciate your feedback as we improve the platform.

6. Acceptable Use

You agree not to:

• Scrape, crawl, or programmatically extract data from the Service.
• Resell, redistribute, or sublicense HAVN data or valuations.
• Attempt to reverse-engineer the APEX valuation model.
• Use the Service to mislead buyers, sellers, or lenders about property values.
• Overload the Service with excessive automated requests.

7. Intellectual Property

The APEX engine, HAVN interface, and all associated branding are the property of HAVN Realty. Listing data provided under licence from TRREB. It remains subject to TRREB's terms.

8. Payment & Refunds

Paid features are billed through Stripe. Subscriptions may be cancelled at any time. Refund requests are handled on a case-by-case basis within 14 days of purchase.

9. Limitation of Liability

To the maximum extent permitted by law, HAVN shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service, including but not limited to financial losses from real estate transactions informed by HAVN valuations.

10. Indemnification

You agree to indemnify HAVN against any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.

12. Changes

We may update these Terms and will post the revised version here. Continued use of the Service after changes constitutes acceptance.
